Allahabad: The Allahabad High Court has dismissed an appeal for the release of a polygamous man accused of abetting suicide by his “second” wife, stating that no Indian woman can “share her husband” with anybody else and remain sane in such a situation.
Justice Rahul Chaturvedi made the remark while dismissing an appeal filed by a Varanasi resident contesting an extra sessions judge’s judgement dismissing his request for discharge in a suicide abetment case.
“An Indian lady cannot, under any circumstances, share her spouse. “They are actually possessive of their husbands,” Justice Chaturvedi said as he dismissed the accused’s plea.
“Any married woman would be shocked to learn that her husband is sharing his bed with another woman or that he is planning to marry another woman. “It would be absurd to expect sanity from them in such an unpleasant circumstance,” the judge stated.
Sushil Kumar, a Varanasi resident, is the subject of an investigation into his “second wife,” who allegedly committed suicide a day after filing a FIR against him at a police station there on September 22, 2018.
Kumar’s “second wife,” whom he reportedly married without divorcing his first wife, with whom he had two children, or informing her of his first marriage, committed suicide after learning that her husband was about to marry a third woman.

The lady said in the FIR she filed before killing herself that she had been subjected to all kinds of persecution and harassment by her in-laws since her marriage to Kumar about 10 to 12 years ago.
The court ruled against the woman’s suicide, saying, “Knowing that her husband had married another woman in a secret ceremony is more than enough motive to commit suicide.” The court dismissed Kumar’s appeal, saying, “Sushil Kumar, the husband, appears to be the major perpetrator at least to be tried for the offence under section 306 of the IPC (abetment of suicide).”
“It was the dead herself who filed the FIR against all the revisionists (the woman’s husband and in-laws) for perpetrating atrocities on her, and these charges could only be verified during the trial, hence there is no good cause for discharge.” “Added the judge.
On September 22, 2018, Kumar’s second wife filed a FIR under the Indian Penal Code (IPC) sections 323 (voluntarily inflicting harm), 379 (stealing property), 494 (marrying despite having a surviving spouse), 504 (insulting purposefully) and 506 (threatening) against her husband and his whole family.
“It is apparent that dead submitted the current FIR against her husband and other in-laws for atrocities during her lifetime,” the court stated after reviewing the facts and evidence on record. Admittedly, the dead was his second wife, whom he purportedly married in 2010, and with whom he has a kid (Kumar).” The court stated,
“The deceased learned unexpectedly that her spouse was planning to marry a third lady on September 11, 2018 in Sarang Nath Temple and had registered for marriage registration.”
