“Swabhimaan ki ladai”: Food delivery executive battles in court following an alleged slap from an Army Major in Gurugram.



The district court in Gurugram has ordered the filing of an FIR against an Army officer for allegedly slapping a food delivery worker in a society in September of last year. Following this, the police booked the accused for allegedly assaulting 27-year-old Sonu on September 9 last year at Bestech Park View Ananda society. In June 2022, the complaint was applied to the court.

Sonu Kumar (27), the delivery executive,  said that he was hit so hard that he partially lost hearing in his left ear.

The sequence of events is described differently by the two men. Sonu, a native of Rajasthan, claimed that after arriving at the society in sector 81 to deliver meals at around 9.45 p.m, a security guard directed him to use the service elevator.

The security guard shouted at me as I stepped into an elevator, telling me to use the other one because it was intended for residents only. A resident from the bottom floor intervened after hearing the disturbance and inquired as to what had occurred. He claimed to be an Army Major. He called me a “gavaar”(illiterate) and inquired as to how I dared to use the other lift. He further said “pata nahi kaun se gaon se aa jaate hai”  “Don’t know from which village such people come from; I was abruptly smacked, punched, and threatened with being arrested by him. Sonu claimed, “I was imprisoned there for 45 minutes.

“The guard and I got into a fight. How come the Armyman stepped in and slapped me? I was very ashamed. In my left ear, I felt an ache. I thus proceeded to the Safdarjung Hospital in Delhi, where the medical staff informed me that I had an injured eardrum, “said Kumar.

When the police arrived, he claimed that they took him to the station where he filed a complaint.

Swabimanki ladai thi (It was a fight for self-respect). The same evening, I complained to the police, but they did not file an FIR. I spoke with top police authorities, but since nothing was done, I decided to go to court.

Sonu, a graduate of a private university in Rajasthan, claimed that during the pandemic, he started working as a food delivery executive. The phrase “Uss Samay Halat Kuch Aisi thi majboori thi” (Circumstances were such that I was desperate for work). I accepted the position in July 2021 since they were paying between Rs 20,000 and 30,000,” he added.

He said that he left his position after the incident. It’s “Kaam koi chota bada nahi hota” (no work is big or small). These folks from high society, however, do not get this. That day, I left my job because I couldn’t bring myself to. It’s all about respect and decency… He continued, “I promised him I will see him in court. I’ve since moved back to my hometown and am employed at my family’s cotton farm.

The chief judicial magistrate issued an order on September 15, 2022, that said in part, “This court is of the considered opinion that it is a fit case for filing of FIR, in compliance with Section 156(3) CrPC. According to the complaint’s contents, the accused committed a crime that is punishable by law, for which registration under IPC sections 506 (criminal intimidation), 341 (wrongful restraint), and 323 (voluntarily causing harm) should be made.

According to a police source, the Armyman’s name is not listed in the FIR. He claimed the accusations against him were untrue when reached. “I then learned that the complainant is not a delivery worker; the security informed me that he illegally entered the building using a fake card. The tower guard requested that he register his information and adhere to Covid guidelines.

The guard said that he forced his way inside the elevator because he would not put on the mask. He shouted and then struck the guard in the chest, causing him to fall to the ground. There was a lot of noise, so I went to investigate. He pushed the security guy once more as I was attempting to calm him down, and then he moved his arm to my side to scratch mine. My arm had a serious cut, and it was bleeding. A medical report is included; the police assessed the issue.

Preet Pal Sangwan, an assistant police commissioner, stated that they have lodged the case and are looking into it. To determine the order of the events, we will review the CCTV footage of the incident and speak with the security guard.
