In an affidavit filed by the Centre before the SC on Monday stated that its decision on article 370 has paved a way of Unprecedented Era of Peace and Progress in Jammu and Kashmir by defending the Article 370 Abrogation. The Affidavit which was presented before the SC stated that “Life has returned to Normalcy in the region after three decades of Turmoil”
Defending its Abrogation of Article 370:
Defending its Presidential order on 2019, Centre has filed an affidavit on Monday stating that abrogation of Article 370 has led to the Dismantling of Terror network in the state of Jammu and Kashmir. And the incidents of stone pelting and street violence have now “become a thing of the past.”
Dismantled the Terror Network says Centre:
It was stated that stone pelting incidents which was connected to the terrorism separatist agenda was reportedly 1,767 in the year 2018 which was effectively reduced to Zero till date of 2024 was stated by the Government in its report.
Organized Bandh reduced from 52 to 0 till date:
In 2018, there were 52 incidents reported for organized bandh/hartal, which has come down to Zero till date of 2024 says the Centre in its affidavit filed on Monday.
The Anti-terror actions taken by the Central Government has resulted in the Dismantling of the terror network by reducing the terrorist recruitment drastically from 199 in 2018 to 12 till date of 2024 says the Centre.
Affidavit Filed a Day Before the New Constitution Bench:
The Centre has filed the affidavit yesterday before the SC which is a day before the constitution of new bench which will start hearing cases from today.
The bench comprising of 5 led by CJI is scheduled to take up the clutch of petitions relating to the article 370 today.
The New Constitution bench of SC comprises of 5 led by Honourable Chief Justice of India Dhananjaya Y Chandrachud which includes Justice Sanjay Kishan, Justice Sanjiv Khanna, Justice BR Gavai and Justice Surya Kant.
The New bench is expected to take up the matter after 3 years of long gap. The Petitions was filed by the Parliamentarians from National Conference Party, Kashmiri Citizens, former Bureaucrats, and various organization have challenged the negation of Article 370.
Article 370 poses Constraints Resulting in Alienation of Region:
In its fresh response to the pending petitions the centre has stated that prior to the abrogation of Article 370 through the order passed in August 05,2019, the state has faced challenges in implementing the beneficial legislation to the people residing in the state of Jammu & Kashmir due to Article 370
And it added that this alienation was fuelled by the terror network which was significantly present in the year 2018 and it has been drastically reduced after the abrogation of Article 370 in the year 2019.
Residents of the Region are enjoying the same rights as other Citizens:
Due to the non- applicability of constitutional laws in J&K has resulted in inevitable deprivation of laws to common people.
After the abrogation of article 370 the extension of all central laws to J&K the residents are enjoying the same rights as other citizens with respect to education, election, reservation and electoral democracy said the Centre.
Unprecedented Era of Peace and Prosperity:
The Centre says after lifting the veil of article 370 the residents of the region has witnessed the unprecedented era of peace, progress and prosperity since 2019. The Centre states in its affidavit that the Normalcy has returned in the lives of the Residents after Three decades of Turmoil.
What is Expected in Today’s Hearing:
On Tuesday the new 5 Judge bench is expected to issue a procedural order to make the matters ready for the hearing on a future date.
The bench is also likely to take up a plea by Shah Faesal who wants to withdraw the petition challenging the abrogation of article 370.
