An eye witness from the Delhi riot shared the occurrence he witnessed while hiding behind the wall. The court charged four guilty for forming a criminal conspiracy, rioting, murder and unlawful assembly.
The Delhi riot in February of 2020 are something that the country would not easily forget. When the citizenship amendment act was passed, and the country was burning amidst the flames of hatred and communal clashes, people faced a lot of losses.
And the most severe losses were in terms of people. The riots in Delhi alone lead to about 53 deaths and more than 700 injuries.
On November 12, a Delhi court framed charges against four alleged murderers from the riots in February 2020. A victim of the violence, namely Deepak, was declared to have died due to hemorrhagic shock as per his post mortem report.
As per the statement of a witness who unfortunately saw the entire event taking place in front of his eyes, he identified four men- Anwar Hussain, Kasim, Shahrukh, and Khalid Ansari.
The Additional Sessions judge Amitabh Rawat declared the charges under various sections stated further in the article. The entire incident is claimed to be a deliberate act.
After learning about the charges in the presence of their lawyer, the accused have pleaded not guilty and requested court trials. Let us take a look at all the details we have so far regarding this case.
Statement of the eye witness
As he claims, Sunil Kumar, the eyewitness of the unfortunate event, shared what he saw that day as per the court order.
On February 25, an unlawful assembly of Muslims came from Kardampuri Pulia, and Sunil stated that they were screaming ‘Allah Ho Akbar’ while trying to cross Pulia Gokulpur. All four of them were armed, and as they came, they started beating Deepak mercilessly.
It is most evident that the first instinct of any person would be to run away from the scene as they see danger approaching, and so did Sunil’s instincts lead him.
He said that he hid behind a wall behind the drain, and there was a gap in the wall from where he could see the evil act of the four men as they mercilessly beat Deepak to his death.
He was able to identify the four men by their names, from which the four were taken into custody.
Charges by the court
As per the official statement, judging by the way, the group arrived at the location of mishappening while being armed and the way they carried out the entire act, it could be said that they had come prepared for conducting and contributing to the riot.
To add on, they might also have framed themselves for murder, like that of deceased Deepak.
In an order released on November 9, the court writ it to be a larger conspiracy, judging it to be a calculated attack on the victim. And by these, the prosecution was able to convince the court to hold the following charges against the said accused.
Under sections 147 and 148, the accused men are claimed guilty of rioting and rioting with a deadly weapon, respectively.
And, under section 149 of IPC, they have been indicted as members of unlawful assembly, guilty of the offence committed in prosecution of the common object. Section 302 has also been indicted on them for murder with 120B for criminal conspiracy.
They have been informed of the charges as per the Code of Criminal Procedure (CrPC). This charge is put to let them know of their offence to prepare for the defense.
