Harassment can’t amount to abetment to suicide: The Supreme Court said.


Verdict relates to the death by suicide of a man who left behind four notes imputing his wife.

The Supreme Court has said simply harassment without encouraging action on the defendant can not be blamed for committing suicide under Section 306 of the Indian Penal Code.

A bench encompassing justices L Nageswara Rao and Aniruddha Bose said: “Mere harassment without any positive action on the part of the suspect proximate to the time of occurrence which led to the suicide would not amount to wrongdoing under Section 306 IPC.

Abetment by anindividual is when anindividual prompts another to do something”.

The bench emphasized that prompting can be inferred where the accused had created such circumstances by his acts or omission that the deceased was left with no option except to commit suicide.

The top court order came when a man had committed suicide by consuming a nasty substance and left four suicide transcripts.

The man ostensibly committed suicide originating from a marital dispute, where the spouse has moved back to her paternal home.

In the notes, the man had criticized his wife and others for pushing him to commit suicide.

In the application before the apex court filed by the deceased’s brother, it was contended that the accused’s abetment of suicide is prima facie made out as the harassment by them.

The requester insisted that his brother was harassed by his wife, due to which he took his own life.

The bench observed in Section 306 Indian Penal Code; there must be a case of suicide.

“In the directive, the individual who is said to have abetted suicide must have played an energetic role by an act of prompting or by doing a certain act to facilitate the commission of suicide,” observed the bench.

Discharging the appeal, the court said: “In the case, the accusations against Respondent Nos. 2 and 4 is that they harassed the deceased.

There is no other material on record that indicates abetment. The high court did not pledge any error in allowing the criminal revision”.
