On 12th October 2022, high court pulled out a decision about marital relationships. Martial relationships of Muslim men, in scope some men of a particular community. Is it good or bad? Why did it target men? Pros and cons? All these things would be addressed in this very article.
Our honorable high court has issued an order regarding Muslim community and their marriage rights. That too they have poured the emphasis on men. Many social activists are against this but let’s find the why and how and then would judge on some parameters.Â
There are multiple cases pending in the courts regarding one nonsense religious potency that a man has, that at any given say time or date he could terminate his marriage by saying a word thrice. So, it made no sense and poured confusion in the jar of injustice. Â
Religion was involved, India is a secular country and all those things did jeopardize a lot of Lifes. Life of the woman and the kids. The home which had only one bread earner… now what? Who will feed the family?
Man of that particular community did manipulate this in their own favor and selfish motives. Maybe said in anger or the arrogance loaded the wits off temporarily. Or the other person was not in sound mind.
As a result, government did remove this right from these men, or from all of the man of that particular community. Because this religious rule was being misused and we do have legal facilities for divorce. Which does serve all the dimensions and have particular provisions.Â
This new rule could be an attempt to put restrictions, more of the hurdles in the way of justice. But we do have cases like defamation as well. So, this move is not that good. But let’s see.
So as so many social atrocities have been mushrooming. We do need to take some steps, those steps which are solution as well as understanding oriented. So, they must be empathetic enough to cater the certain and specific needs of the community or minority suffering.
