The GST Council resolved on Tuesday to lower the tax on food and beverages sold in movie theatres while raising the tax on “bets placed” on online games, chips bought at casinos, and bets made with bookies at horse races.
In addition, it changed the scope of sports utility vehicles and excluded some imported foodstuffs and medicines used by people with uncommon diseases.
Additionally, free from CST were the satellite-launching services provided by private organizations.
The Council explained that the tax will be reduced from 28% to 5% GST, which is at par with eateries, so moviegoers can rejoice at the move. An official statement stated that “the sale of movie tickets and the supply of food and beverages are clubbed together.Â
KEY CHANGES IN CARS AND MEDICATIONS FOR GST:
- The government will introduce legislation to put horse racing and internet gaming under the GST.
- Services offered by private parties will now be free from GST for satellite launch services.
- Redefines SUVs as vehicles with a 1500 cc engine, a length of at least 4 meters, and a ground clearance of at least 170 millimeters when empty. Sedans should be categorized differently.
- The GST Appellate Tribunal’s rules will go into force in August. The tax council adopts the president and member appointment regulations.
- When imported for personal use, there is no IGST on medications and foods used for specific medical objectives in the treatment of uncommon disorders.
Even though Nirmala Sitharaman, the finance minister, made it clear that the Centre and the States wished to promote industry, they could not push casinos and online games more than necessary commodities, the gaming sector continued to vehemently object.
The Union and state finance ministers’ infinitely powerful panel, which had been debating the tax idea on internet gaming and casinos for nearly three years, finally agreed to take the finger at its 50th meeting, despite fierce opposition from influential parties. The idea has also eliminated the distinction between “game of fate” and “game of ability” however, it will necessitate legal revisions to incorporate internet gaming and horse racing within the scope of GST.
We are not looking at what is based on skill and what is dependent on chance. We are looking at what is taxed,” Sitharaman said, adding that the Council had held thorough discussions before making the decision and had taken into account the concerns of the states who relied on casinos to draw tourists.
The proposed change may have a big financial impact on the exchequer and will elevate states like Goa and Sikkim in terms of their ability to generate revenue. Numerous changes to the CST law will be necessary as a result of this development, particularly in regard to the definition and taxability of GST actionable claims. What is still up in the air is whether this modification would take effect retroactively or prospectively, according to Kishore Kumar, head of Taxmann’s indirect tax practice.
