Infosys has banned ex-employees from working for other major IT firms like Wipro, TCS, Cognizant, IBM, and Accenture.
According to the non-compete clause, Infosys banned all its ex-employees from joining any of the major IT firms. The ex-workers of the company were not allowed to work for Wipro, TCS, Cognizant, IBM, or Accenture.
The clause states:
“For a period of six (6) months after my employment with Infosys is terminated for any reason, I will not:
a. Accept any offer of employment from any customer with whom I have worked in a professional capacity in the twelve (12) months immediately preceding the termination of my employment with Infosys.
b. Accept any offer of employment from a named competitor of Infosys if such employment would require me to work with a customer with whom I had previously worked in the twelve (12) months before the termination of my employment with Infosys.”
The firm has clearly mentioned the names of its competitors, such as Wipro, Cognizant, IBM, TCS, and Accenture.
To put it simply, the condition prohibits any former Infosys employee from working for these five IT businesses for the next six months. Furthermore, for this condition to apply to an ex-
employee, these businesses must have had the same customer as Infosys workers in the previous 12 months.
Why did Infosys ban its employees from working for other IT firms?
In the last 3 months, around 80,000 employees have resigned from Infosys. The competition amongst IT firms is soaring. All the firms are attacking each other to buy the talent of their competitors.
This is a major reason why many employees switch between these competitive firms. However, Infosys wants to stop this desperately. The need to stop the war is clearly visible in Infosys in the clause demanding the current employees to stop resigning.
The Nascent Information Technology Employees Senate files a complaint.
Due to the new rules established by Infosys, the employees asked NITES (the Nascent Information Technology Employees Senate) to look into the matter.
The President of NITES, Harpreet Saluja, has filed a complaint with the authorities of the Ministry of Labour and Employment against the authoritarian rule imposed by Infosys on its employees.
