For allegedly hurting religious sentiments and promoting enmity through his tweet, Delhi court on Tuesday remanded Mohammed Zubair.
According to CMM Snigdha Sarvaria the recovery of device through which the tweet was made is pending as Mohammed is not cooperative.
The submissions regarding the image included in the tweet in question being a part of the film “Kissi Se Na Kehna” of the year 1983 are also of no assistance to him at this stage, claimed Senior Advocate Vrinda Grover. She said Zubair was called for questioning in a 2020 FIR, but he was detained under a separate FIR and the remand copy was not given to him. She said the FIR’s allegations against him are unfounded.
The FIR said that Zubair’s statements and photo against a certain religious community were highly offensive and could encourage hatred, which could harm public tranquilly.
The 2020 case is currently before the Delhi High Court and involves a petition by Zubair to nullify the FIR issued against him on a Twitter user’s accusation. The case involves a tweet by Zubair, who shared Singh’s profile photo with his granddaughter and asked if it was appropriate for Singh to use insulting language while using a picture of his granddaughter.
Zubair was granted interim protection from arrest by a single judge panel of Justice Yogesh Khanna on September 9, 2020. The bench also ordered the Delhi Government and the Deputy Commissioner of Police, Cyber Cell, to file a progress report on the inquiry.
