The Patiala District Bar Association (DBA) is declaring a ‘no work day’ on Friday to protest against the alleged illegal search conducted by police at the chamber of an advocate on Thursday.
Advocate Himanshu Girdhar wrote to the Patiala District Bar Association saying he was in the court on Thursday when he received a call from one of his client that some cops had entered his chamber and conducted a search.He said the police officials, without informing him, took away one Parminder Singh, who was at his chamber to sign documents. He said the whole scene was recorded on a CCTV camera.Advocates said the police had trespassed the advocate’s chamber.
Trespasser means
According to Merriam Webster Dictionary A person who enters or remains on the real property of another wrongfully or without the owner’s or possessor’s authority or consent is called trespasser.
Trespass Against Person
It is the causing of apprehension of unreasonable interference with one’s person and body and includes usage of force causing damage and impairment in the body. The trespasser, with an ulterior intention, transgresses the right of another and makes an alteration in it with the objective to cause wrongful loss or wrongful gain as the case may be. It is considered as intentional even if the wrongdoer did not know that the property belonged to another.
The police officials took away a man who is an accused in a case from the chamber in the advocate’s absence.
Steps taken against trespass
Patiala DBA joint secretary Aman Mathur said that the executive body has taken the matter seriously. The president has assured the advocate of our support and that we will demand strict action against the erring police officials. The bar and the executive body stand resolutely behind its legal fraternity. It seems the action is illegal and it threatens the practice of independent advocacy.
Sharing the CCTV footage, the joint secretary said that We condemn the action by the police and want them to issue a written apology.
The Patiala police have suspended three police officers accused in the matter.
The executive body of the DBA had unanimously decided to go on a complete ‘no work day’ on Friday, he added.
Patiala DBA president Jatinderpal Singh Ghumaan said SSP Varun Sharma had assured them that strict action will be initiated against the erring officials and that appropriate guidelines will also be issued.
