The Supreme Court said today that it is concerned about the growing number of instances in which judges are being targeted and noted that it has become fashionable in recent years to level charges against judges. It was said that this was particularly common in the states of Maharashtra and Uttar Pradesh, and the court refused to intervene with a decision from the Madras High Court that found a lawyer guilty of contempt and sentenced him to 15 days in jail for his actions. According to what was claimed, “the stronger the judge, the harsher the charges.”Â
Justice DY Chandrachud said that judges are being assaulted all throughout the nation and those district judges do not have any kind of protection; in certain cases, not even a police officer armed with a lathi is available to protect them.
The court affirmed the jail sentence while also stating that legal professionals are not above the law. According to what it stated, “They will also be required to face sanctions if they attempt to hinder the legal process.”
While issuing a warrant that cannot be released on bond for the accused lawyer, the court said that “such attorneys are a blight on the legal process and should be dealt with rigorously.” “This individual is utterly incapable of being reformed. He is a member of that category of attorneys who are completely beyond redemption. They are a stain on the reputation of those who practice law “it was said in a comment with a very forceful tone.
“A warrant that cannot be released on bail was issued against him by the court. After he was discovered at a tea shop close to the High Court, one hundred counsels piled on top of him to prevent the Non-Bailable Warrant (NBW) from being served. There is video surveillance…and to make matters worse, when the subject was brought up again, he made accusations against Justice PT Asha, “According to Justice Chandrachud.
The court said that a sentence of two weeks in jail is a very mild penalty and that the defendant would feel some sorrow when he is sentenced to serve those two weeks in jail and when he is prohibited from practicing law again.
Justice Chandrachud made the observation that overtly intimidating or threatening judges has developed into an accepted norm in certain High Courts. They dare you to issue an NBW against me, he said. “Dare issue an NBW against me.”
“You are not allowed to make baseless accusations. Imagine 100 attorneys assembling. Even attorneys are required to abide by the rules of the court… The practice of leveling accusations against judicial officials has recently gained popularity “Justice Chandrachud made a statement and said that a significant number of instances of this kind are being investigated in Mumbai, Uttar Pradesh, and Chennai respectively.
The attorney said that he had tried to make amends by apologizing without conditions, but the Supreme Court had declined to take action.Â
