Former Judges, bureaucrats and army veterans have signed an open letter to the Chief Justice of India. The letter criticizes Supreme Courts’ refusal to club Nupur Sharma plea to club hate speech cases filed against her.
A group of citizens, comprising of ex-judges, bureaucrats and ex-armymen have signed an open letter to the Chief Justice of India. They argue that the Supreme Court’s observations on Nupur Sharma violate judicial propriety and fairness. Among the signatories are 15 High Court judges, 77 civil servants and 25 army veterans.
“The observations , simultaneously relayed by all channels in high decibel, are not in sync with judicial ethos. By no stretch these observations can be sanctified on the plank of judicial propriety and fairness,” their letter argues. “ The observations, judgemental in nature, on issues not before the court, are a crucifixion of the essence of the Constitution. Forcing a petitioner by such observations, pronoucing her guilty without trial and denying her justice cannot be the facet of a democratic society, It states.
J&K Human Rights Organization Criticizes the Supreme Court
Forum for Human Rights and Social Justice, a Kashmir based organization, also sent letters to the Chief-Justice. The organization is headed by Jammu based advocate SS Nanda. It has called the judges to withdraw their observations
The Supreme Court had denied Nupur Sharma’s pleas to club hate speech cases against her. A vacation bench of Justices Surya Kant and B Pardiwalla argued that Nupur Sharma’s comments were irresponsible.
“ The way she ignited emotions across the country, this lady is singlehandedly responsible for what is happening in the country,” Justice Surya Kant said. Nanda’s letter calls for either the withdrawal of Justice Kant’s roster, or a repudiation of his judgment.
