On June 27, the Ministry of Electronics and Information Technology issued a notification to Twitter Inc’s Chief Compliance Officer, offering the business “one last chance.”
Twitter has petitioned the Karnataka High Court for a judicial review of the government’s order for the microblogging company to remove information from its site.
This is despite the fact that the corporation cooperated with the information technology ministry’s July notification to remove some content.
The specifics of the material could not be determined.
According to Reuters, Twitter stated in its motion for judicial review that some removal orders did not meet the procedural standards of India’s IT Act, without stating which ones.
An email submitted to Twitter about the petition received no response. Attempts to contact the IT ministry about the situation were likewise futile.
At a press conference, Union Information Technology Minister Ashwini Vaishnaw noted that social media is important because it is accessible.
Social media coverage has become a universally accepted question. It is important to respond to it, which will begin with self-regulation, followed by industrial regulation, followed by state law. Said Vaishnaw.
Any legal changes required will be made. Within the media groups, self-control is required. self-regulation will be done but wherever necessary, we will take steps to make social media more responsive. Said Vaishnaw.
Globally, governments and civil society are moving in a way that makes social media more responsive, he added.
While one area is accountable, the other is the need to look at how content producers should profit from social media, especially if the latter are benefiting from the content. he said.
The minister also stressed that any company in any field must adhere to the laws of the country.
Twitter has been working with the government for some time to remove content from its site.
A Notice To Twitter Inc
On June 27, the Department of Electronics and Information Technology (MeitY) issued a notice to Twitter Inc.’s chief compliance officer, giving the company “one last chance” to take action with multiple content reductions on July 4. Failure to comply could result in loss of immune function as a coordinator under -IT Act, 2000, said the Department.
In May the government had asked Twitter to take action on content related to Khalistan and Kashmir. According to media reports, the government has asked Twitter to delete 60 accounts and tweets of journalists, politicians and supporters of farmers’ protests.
A department official then told Business Standard Twitter that he had failed to comply with those notices, issued under Section 69 (A) of the IT Act. The telecommunications platform company also failed to comply with the occasional non-compliance notices, the official said. However, the details of the content remain unclear.
In terms of Section 69 (A) of the Information Technology Act, 2000, the government has the power to issue directives to restrict public access to any information under certain circumstances. It may order the reduction of digital knowledge in the interests of imperialism, integrity, and defense of India, state security, friendly relations with foreign states, or public order.
Meanwhile, the government has proposed the establishment of a grievance redressal committee that will look into applications lodged by people who oppose the decisions taken by the grievance redressal management forum.
Meanwhile, Twitter, in its public report for the period 22 April, 2022, to May 25, 2022, said it had received 1,583 complaints and 1,621 URLs (similar service points) were taken. At the same time, it has received 115 complaints about the suspension of the Twitter account.
The court also suspended 46,526 accounts further. Of these, 43,656 were suspended for issues such as child sexual abuse and related matters, and 2,870 for supporting the cause of terrorism.
It shows some low. Twitter’s strategy has been to get as far back as possible using the legal tools they have. It is a way of delaying or sometimes trying to get certain agreements from the government. To some extent there is power in this strategy. We are talking about an amendment to the Bill and the government has begun negotiations. But you also see Twitter agreeing to some of the government’s requests. While compliant in some cases it backslides. said the lawyer.
