Representatives of the 22nd Law Commission and the Law Ministry will meet the Parliamentary standing Committee to discuss on “Uniform Civil Code” on Monday (July 3, 2024).
Parliamentary meeting on UCC:
The Parliamentary standing committee on Thursday called a meeting on Uniform Civil Code (UCC).
During the meeting they said the views of the stake Holders will be discussed.
Views Will be Sought and Considered on July 3:
The committee led by BJP Rajya Sabha MP Sushil Modi informed all the 31 MPs and members of the committee said that their views on UCC would be sought and considered at the meeting on July 3rd at 3:00 pm.
Committee Inviting Views from Various Stake Holders:
The Legal commission has invited the views of various holders on the Uniform Civil Code under the headline “Review of Personnel Laws” by issuing a public notice on June 14 ,2023, and 30 days, time period was given to the people.
8.5 Lakhs Response to the Public Notice Issued:
Till 27th June 2024, in the evening, the law panel had received 8.7 lakh responses to its public notice inviting views on the Uniform Civil Code.
This was the second time the Government called for the views on developing the framework of Uniform Civil Code for the nation.
The Last Law Commission (21st), had reviewed the matter for 2 years and came up with the report on 2018 stating that Uniform Civil Code is “neither desirable nor needed”.
PM’s Argument for UCC:
A strong argument was put forth by Prime Minister Narendra Modi on Tuesday.
Prime Minister said that a country cannot function with two laws, when our Constitution speaks about equality for all (Article 14).
Prime Minister Narendra Modi further added that a family cannot run with two different rules for its members.
Our constitution too grants equal rights to all irrespective of his caste and creed- said Pm Modi on Tuesday.
Uniform Civil Code – Law Commissions 2nd Proposal:
The Uniform Civil Code is a proposal to formulate and implement a single personal law which applies to all the citizens equally by replacing the various personal laws present currently. This idea was put forth before the Parliament for the 2nd time. The Previous Law Commission had also proposed for UCC which was not successful.
This time the proposal was laid down before the house on June 28th 2024, by PM Narendra Modi.
And the Proposal of UCC has gained support from AAP, Shiv Sena, etc., who have extended their support for UCC.
UCC Role in our Constitution:
Vision Since Independence:
UCC has a long history in India. Many leaders wanted to implement UCC in India and one such person was Dr. B.R. Ambedkar well known as the Father of our Constitution and the person who played a vital role in drafting our India’s Constitution was a supporter of Uniform Civil Code and supported the implementation of Uniform Civil Code in the Constituent Assembly Debates.
Article 44 on Uniform Civil Code:
Article 44 of the Constitution lays down that state shall endeavor to secure a Uniform Civil Code for the Citizens throughout the territory of India.
States Started Implementing Uniform Civil Code:
The 1st state to implement the UCC was Goa and now Uttarakhand is planning to implement the UCC for its state after the SC’s Judgement stating that the state Government (in this case Uttarakhand) has the constitutional jurisdiction to implement UCC.
Unity in Diversity:
India the country, which is well known for its Unity in diversity, is now moving forward to implement the UCC in our country. If it gets implemented, then this will be marked as an era of Law Revolution.
