Uttar Pradesh: The Uttar Pradesh government informed the Supreme Court on Friday that it has withdrawn 274 recovery notices for damages caused to public property during protests against the CAA (Citizenship Amendment Act).
In December 2019 CAA, which was issued before the enactment of a 2020 law laying down the recovery procedure ā and that tribunals established under the new Act will deal with the issue anew.
Accepting the submission, a bench of Justices D Y Chandrachud and Surya Kant directed the state government to proceed under the new statute.
The Uttar Pradesh Recovery of Damage to Public and Private Property Act, 2020, and to return any recoveries already made under the withdrawn proceedings.
The state urged the court to maintain the status quo, claiming that a refund would convey the wrong message about deterrence, but the bench ruled that all acts related to it must also be removed when a proceeding is withdrawn.
