Observing the plea of Irfan in Allahabad High Court, the bench rejected his plea to play Azan on loudspeakers. The bench settled the case by declaring that playing Azan on loudspeakers in Mosques won’t be considered a fundamental right.
Irfan, from Noori Masjid, had previously been rejected on his application requesting permission to play Azan on loudspeakers in his village mosque. The SDM Tehsil Bisauli of Badaun District rejected his application to play loudspeakers at the time of Azan.
After his application was rejected, he sought to seek help from Government authorities. He disagreed with the SDM’s order and declared it illegal and a violation of his rights.
Allahabad High Court’s Decision
The HC settled the law on the use of loudspeakers to play Azan in mosques as not a fundamental right. The bench of Justice Vikas and Justice Vivek Kumar Birla dismissed the petition on the grounds that it was misconceived.
During the lockdown, the Allahabad HC had allowed the mosques to recite Azan in May 2020. Azan is noted to be an integral part of the Islamic religion by the Allahabad High Court.
However, playing Azan on loudspeakers and the use of microphones is not an essential part of the prayers.
Usage of Loudspeakers in Temples
Recently, after rejecting a contempt plea on using loudspeakers in Temples and Mosques in Allahabad High Court. The court’s decision amidst the state elections was to maintain communal harmony in the state.
