The panel of Justice D.Y.Chandrachud and Justice B.V.Nagarathna on Friday noticed that appeal raised some reasonable points. These affordable points are about the furnishing of health services. But it also demands some obstructive prayers.
Discussion on Ayushman Bharat Health Card
By dissolving the petition, the jury said to the appealer’s advocate to rewrite the appeal. It asked to remove the little prayers and keep the petition focused only on Ayushman Bharat. The panel suggested first edit these things and then coming back.
The petition on Ayushman Bharat is to provide directions instantly to the private hospital. It is for the sake of all the needy people.
So that all the needy people who are the holders of the Ayushman Bharat Health Card can be admitted to the private hospitals for Covid-19 treatment. On this, the panel wants to conduct its administration.
Bharat Swaroop Sharma, an advocate, put forward the requests in the petition that were appealed during the Covid-19 second wave.
Moreover, at the time frame, the family members were not supposed to get inside the ward. Advocate P. Sureshan also presented that they can delete the little prayers if the panel wants that.
Setting up of CCTV cameras
The panel marked that the Supreme Court couldn’t utilize its authority to provide directions to the doctors to write English and any one of the other languages on the prescription.
While replying to the abovementioned prayer, Justice Chandrachud replied that ” We can’t do that , there are other places like rural areas.” He also noticed that the prayers concerning the setting up of CCTV cameras at the private hospitals are a rupture to privacy.
So it can’t be allowed. Apart from the above mentioned, the PIL requested directions from the Central Government.
It asked for to suggest the instructions for setting up the CCTV cameras across all the private hospitals throughout the country, steps for all the doctors to write the prescriptions in any local language or English.
It also said to name the alternative brands of medicine that are supposed to be present in the medical stores in the market.
Creating more private hospitals
It also recommended reserving 60% beds in almost all the private hospitals throughout the nation for the people who are the Below Poverty Line (BPL) cardholders.
It instructed to create control rooms across the country to highlight the miseries and sadness of the public, especially for the economically weaker section of the society, about the everyday issues and problems they had to bear and undergo relating to the health services.
It created protocols to set down more and more private hospitals throughout the nation to exhibit the fees and price for each of the health services provided by that particular private hospital. It urged to create disciplinary actions in response to the refusal of such necessities.
It said to maintain the rules and protocols and to frame new rules if needed to ensure the black-marketing of the essential medicines, cylinders of oxygen etc.
Ensuring SDGs
The appeal, as mentioned earlier, was documented by the All India Consumer Protection and Action Committee. It wanted to enhance the level of clarity in the system.
This petition further declared that Ayushman Bharat, a preliminary plan of the Government of India, was inaugurated as prescribed by the National Health Policy.
This national policy occurred in 2017, and the vision and purpose of this policy were to achieve Universal Health Coverage.
In accordance with this, the Government issued Ayushman Bharat Golden Card to enable portable transactions by the PMJAY policy.
The purpose behind the planning of this inventiveness was to meet the Sustainable Development Goals (SDGs). The inheritors are supposed to get the Ayushman Bharat Yojna card. This card consists of all the crucial pieces of information about the patient.
