Soren, Chief Minister of Jharkhand as an MLA.Â
Earlier Jharkhand Governor Ramesh Bais had sought the opinion of EC over a complaint by the opposition BJP

Some sources say that EC has written back to the Governor recommending him to disqualify the CM as MLA.

“The Chief Minister is apprised of several media reports about ECI sending a report to Jharkhand Governor
“apparently recommending his disqualification as an MLA”. No communication in this regard has been
received by CMO from either ECI or Governor,” Jharkhand CMO said in a statement.
The chief minister’s office said, “It seems BJP leaders, including a BJP MP and his puppet journalists
themselves drafted the ECI report, which is otherwise sealed. Blatant misuse of constitutional authorities and
public agencies and its takeover by BJP HQ in a shameful manner is unseen in Indian Democracy.”
According to reports, the EC in its findings has found Hemant Soren in violation of office-for-profit. Jharkhand CM violated 9A of the 1951 People Representative Act
ECI is probing a case against CM Hemant Soren in which he awarded himself a mining lease. The opposition BJP has asked for his disqualification as an MLA alleging corruption.
Article 192 of the constitution suggests that if a case arises on whether the sitting member of the house of legislator of a state be disqualified or not, the final authority lies with the Governor of the concerned state.
