Bombay high court has directed the urban development department, Maharashtra police, and former Thane Municipal Corporation commissioner, R A Rajeev, to respond to a petition filed by Shiv Sena MLA Pratap Sarnaik to take action against RA Rajeev for reportedly violating procedural rules.
Sarnaik claims that the commissioner had collected money for carrying out the renovation work on behalf of TMC’s town planning department without the approval of the government.
Sarnaik, representing the Oval-Majiwada constituency in Thane, directed the state to prosecute Rajeev under section 7 of the Prevention of Corruption Act and to set aside the April 2014 order refusing sanction. The petition also sought directions from the Maharashtra police for legal action against Rajeev after the government allowed his prosecution.
A bench of justice Prasanna Varale and justice Sharmila Deshmukh was informed on Monday that a petition filed in 2013 was disposed of due to the state government’s refusal to sanction. The court had then directed Sarnaik to file a new plea challenging the refusal.
The new petition in 2015 claims that Sarnaik questioned the contract, appointment and payments made to the contractor for the work. The MLA also asked the departments concerned to investigate whether payments were made to any other person and whether the payments were connected with unauthorised works in Thane.
Sarnaik’s plea stated that he had written several letters to the authorities however, he had not received any reply from the urban development department or police.
After the hearing, the bench directed the state government, the police, and Rajeev to respond to the petition and posted it for further hearing after three weeks. In a previous hearing in June, the High Court allowed Sarnaik to amend the petition and change their address and contact details of Rajeev as he had retired from service. The petition was then permitted as the sanction to prosecute was being sought for an offence that had occurred when Rajeev was in service.
