The High Court grants bail to Maharashtra’s former home minister Anil Deshmukh in a corruption and abuse of power case filed by the Central Bureau of Investigation(CBI).
Deshmukh, 74 was involved in two cases one by the CBI for the offense of corruption and the other by the Enforcement Directorate for the offense of money laundering. Deshmukh applied for bail in both cases, On October 4, 2021, he was granted bail by the Bombay High Court for the offense of money laundering registered by the Enforcement Directorate, however, held by a special court for the offense of corruption registered by the Central Bureau of Investigation (CBI). Then, he approached the High Court.
Former home minister’s bail application statement –
His bail application stated, “He is a septuagenarian suffering from several serious ailments which have virtually incapacitated him to undertake ordinary pursuits of life without adequate medical treatment, is beseeching for a benevolent indulgence of court to admit him to regular bail in peculiar facts and circumstances which give rise to a reasonable inference that the entire proceedings are not only actuated with malice but also bereft of any legal sanctity.”
ED had alleged that Deshmukh collected Rs 4.7 crore from the bars and restaurants in Mumbai through police officer Sachin Waze.
After the Central Bureau of Investigation probe in April 2021, a First Information Report(FIR) was registered against Anil Deshmukh and his associates for alleged corruption and misuse of official power.He has been in Judicial custody since November 2, 2021.He applied for bail last month based on medical grounds but got rejected.
Today, Justice M.S Karnik allowed Mr.Deshmukh to be released on a surety of Rs 1 lakh. However, held in abeyance for 10 days as CBI decided to challenge the case in the Supreme Court. His case is led by Senior Advocate Vikram Chaudhari and Advocate Aniket Nikam who states that Deshmukh must be bailed in the CBI case as both the ED and CBI case are connected and he got bail for the ED case after a thorough investigation.
Chaudhari argued ‘The HC bail order (October 4) in the ED case also said that in all probability, Deshmukh may not be convicted. He has suffered for over a year in incarceration and if he continues to remain in custody, it will be an injury to justice,”
In April 2021, Deshmukh resigned from his post as Maharashtra’s Home Minister after the order of the High Court for a CBI probe into the corruption charge against him.
