Anil Deshmukh, the senior leader of the National Congress Party (NCP), once again is seeking bail in the corruption case filed against him, which is being investigated by the Central Bureau of Investigation (CBI) and Enforcement Directorate (ED), since 2021. The former Home Minister of Maharashtra state on October 26, 2022, approached Bombay High Court to seek bail.
The plea will be heard in the court on November 11, 2022. On October 22, 2022, Deshmukh’s request for bail plea was refused by the Special CBI Court in Mumbai. In addition, a request for urgent hearing on the case was made by Aniket Nikam (Deshmukh’s lawyer), before vacation judge Sharmila Deshmukh on Wednesday.
The CBI has been asked by the court to respond on the matter by November 9. The 73-year-old NCP leader is currently in the judicial custody.
What is the case?Â
The former minister is being held for the charge of corruption after he was accused of bribery by the former Police Commissioner of Mumbai Police, Param Bir Singh, in a letter. After the matter was brought up, Bombay High Court ordered the CBI to conduct an investigation into the allegations, following which the Minister had to resign from his post.
ED is probing the accusations of money laundering while CBI is looking into any offences committed under Indian Penal Code (IPC) & Prevention of the Corruption Act. Advocate Dr Jaishri Patil filed the complaint, based on whose preliminary investigation’s ascertainment, Deshmukh was held in custody along with others.Â
It is believed the minister was involved in money laundering, misconduct of his power, and alleged bribery during his short time of service as Maharashtra’s Home Minister from 2019 – 2021. Deshmukh was arrested in November 2021.
Earlier plea’s of Deshmukh
The former minister filed bail plea in March this year, in the money laundering case lodged by ED which was then denied by the Prevention of Money Laundering Act (PMLA) court, but later on, on October 4, Deshmukh was granted bail in the same case. This decision was also then supported by the highest court of the country on October 11.
Seeking hope, the politician then desired to get clearance in the case looked by CBI and therefore, moving to the CBI court, wanting bail in the case. This time, the Special Judge rejected the bail plea following which the minister has filed the current plea, which is to be heard next month.
Denying the bail plea, the court noted that Deshmukh is under ‘some serious allegations and required to be looked into before bail is granted to him’.
Following the accusations, the minister’s residence was raided along with other places in Maharashtra.Â
