For a long time, many fans have been anticipating the film’s OTT release. The Bombay High Court recently dismissed a petition brought by Mad Man Productions seeking a halt on the film’s digital and satellite release.
The Mad Man Productions had filed a lawsuit against Reliance Entertainment Studios Pvt. Ltd, Phantom Films Pvt. Ltd., Star India Pvt. Ltd., Netflix Global LLC, and others, seeking a stay against the film 83’s digital release for alleged copyright infringement.
They claimed that intellectual property ownership was shared between them (37.5%), Reliance Entertainment (37.5%), and Vibri Media Pvt. Ltd., one of the film’s producers (25 percent). The Bombay High Court, however, dismissed the appeal, stating that the consent terms do not apply to 83 because the agreement was reached before the terms were passed.
According to the court, Mad Man will only obtain rights to the picture 83 after the first ten years of its release. Star India and Netflix, which own the digital and satellite rights to 83, claimed to have reached an agreement far before the film’s release date of 2021.
The film’s rights were given to Star India in 2017, and Netflix India entered the scene in 2019. Justice Riyaz Chagla noted that Star India and Netflix have antecedent rights of exploitation of the subject film on satellite and digital media and which has acknowledged and accepted by Plaintiff, Mad Man and the application gets rejected.
Hotstar and Netflix were granted authorization to stream the film on their OTT platforms as a result of this judgement. All of the fans who had been anticipating it are surprised.
