SC grants: On Wednesday, Varavara Rao, an activist and accused in the Bhima Koregaon case, was granted bail by the Supreme Court on medical grounds.
He had challenged the Bombay High Court’s April 13 order rejecting his plea for permanent bail on medical grounds and is currently on interim bail.

The court ruled in its order that Rao must not misuse his freedom in any way. In addition, the court declared that granting bail was solely based on medical necessity and that it would not have an impact on the case’s merits.
Rao’s appeal of the Bombay High Court’s decision to deny his request for permanent medical bail was being heard by the SC grants panel presided over by Justice UU Lalit. Rao was out on interim bail due to his health. He was told to surrender himself before the court on July 12. His bail was then extended by the Supreme Court on July 12 until further orders.
The Additional Solicitor General, Suryaprakash V Raju, argued during the hearing that Rao should not be given the bail. He also cited Rao’s association with the outlawed group, CPIM. See here.

ASG said, “The nature of activities by the person is dangerous and harmful for the nation. He is a very shrewd person.” He added that Rao wanted to bail based on his medical condition but he did not visit the hospital at all.
The SC grants ordered Rao not to consider leaving the jurisdiction of the concerned trial court without the trial court’s permission while granting bail. The court has warned him not to misuse his freedom in any way and directed him to stay away from the witnesses. Additionally, he has been instructed to notify NIA of any medical attention he receives.
The court further made it clear that the bail was granted solely on medical grounds and will not affect the merits of the cases against the other accused or the appellant.
The activist Varavara Rao has come under fire for allegedly making inflammatory remarks at the Elgar Parishad conference in Pune in December 2017. Rao was detained by the police after his speech on December 31, allegedly saying that it was a contributing factor in the violence that broke out the following day near the Koregaon-Bhima war memorial on the outskirts of Pune. The police also pointing out that the event’s organisers had connections with the Maoist organizations. The task of conducting the investigation was given to the NIA.
Bhima-Koregaon, a small village in Maharashtra’s Pune district, is associated with an important period in Maratha history. A Dalit-dominated British Army defeated a Peshwa army led by Peshwa Bajirao II in Koregaon on January 1, 1818.
The Bhima Koregaon case dates back to January 1, 2018, the day of the bicentenary celebrations of the Bhima Koregaon battle. The celebration was marred by violence, leading to the death of one person and injuries to several others.
Tensions began to rise on December 29, 2017, the day Govind Gopal Mahar’s memorial was discovered desecrated. On December 31, 2017, the incident was mentioned at the Elgar Parishad, a large public conference organised by Dalit and Bahujan groups. According to police, inflammatory speeches were made at the event, which led to the violence the next day.
Rao was arrested on August 28, 2018, at his home in Hyderabad. He is currently on trial in the case. On January 8, 2018, Pune Police filed a FIR against him under several sections of the IPC and UAPA.
