The 21st constitution amendment will abolish the 20A of the Constitution which empowers the authority of the executive over the parliament. It was introduced by President Gotabaya Rajapaksha after securing the landslide victory in the 2020 general election, and after eradicating the 19th amendment of SriLanka’s constitution which was empowering the authority of parliament. Justice Minister wijeyadasa said that discussions on the constitution amendment were held with support of President Gotabaya Rajapaksha last week. According to Srilanka’s Media reports, Prime Minister Ranil Wickremesinghe, Justice Minister Wijeyadasa Rajapaksha and Foreign Minister G L Peiris were participating in the discussion on the 21st amendment.
Justice Minister wijeyadasa said that proposals of the various political parties are also included in the Draft Amendment which will be introduced for approval to the cabinet on Monday. He further said the Draft will be Gazetted after the approval of the Cabinet and he gives a statement on the amendment in the Parliament next week.
The 21st constitution amendment will reduce the executive power to a ceremonial head of the armed forces and the President could exercise power related to the appointment of Cabinet Ministers and Prime Minister.
After the constitutional amendment, the executive power related to the appointment of important position holders will be transferred to the Constitutional council. This proposal of transferring the executive power to the council was also reflected in the private members’ bill which was introduced by the Members of Samagi Jana Balawegaya (SJB) and Sri Lanka Podujana Peramuna (SLPP).
The council will consist of seven Members of Parliament and three members from civil society.
The President will now exercise their power on the advice of the Prime Minister and will be held accountable to the parliament. Similarly, under 21 A, the cabinet ministers, the National Council and the fifteen committees and oversight committee will also be accountable before the parliament.
This constitutional amendment is introduced in the meantime when the country is facing the worst financial crisis since its liberation in 1948 from British colonial rule.
Meanwhile, in April, International Monetary Fund declared Sri Lanka’s debt as unsustainable and therefore, Srilanka is struggling to get an IMF package for its economy. In Which, India also expressed full support in the Forum to get financial assistance for Sri Lanka.
India is not only supporting Srilanka on international forums even it has given around 3.5$ billion as financial assistance including creditors line and millions of dollars worth of medical, food, cooking gas and fertilizers supplies to Sri Lanka.
