Sunil Prabhu of the Shiv Sena (Uddhav Thackeray) party asked the Maharashtra Legislative Assembly Speaker to swiftly deliberate on the disqualification appeals pending against dissident Sena MLAs led by Eknath Shinde, and the Supreme Court gave notice in response on Friday.Â
Supreme Court’s Decision:
A bench made up of CJI DY Chandrachud, Justice PS Narasimha, and Justice Manoj Misra was presented with the case. CJI DY Chandrachud issued the following order in the case:
Issuance of the notice was allowed. Returnable within two weeks.
For the petitioner, senior attorney Devadatt Kamat made his appearance. The Supreme Court ruled in a case involving the Shiv Sena rift on May 11, 2024, that it could not force the reinstatement of the Uddhav Thackeray cabinet since Thackeray had resigned without taking a floor test. The Supreme Court further declined to exercise its authority under Articles 226 and 32 in this case to resolve the disqualification problem.
The Speaker was therefore given the authority to rule on the disqualification petitions by the court, with the additional instruction that the speaker “must decide the disqualification within a reasonable period.”
On June 23, 2022, after the MLAs rebelled against Thackeray, Sunil Prabhu, the Shiv Sena party whip, filed the disqualification petitions against the rebel MLAs. In the Speaker’s absence, the notices of disqualification were issued by Deputy Speaker Narhari Zirwal. The Supreme Court ordered the speaker to consider the disqualification pleas, but it has also been claimed through the petition that the petitioner sent more than three more representations to schedule a hearing in the aforementioned disqualification concerns.
According to the petition, the Speaker is a judicial tribunal that must act fairly and impartially in carrying out its duties under Paragraph 6 of the Tenth Schedule.
Eknath Shinde on Uddhav Thackeray:
According to Maharashtra Chief Minister Eknath Shinde, even after having used the names of Bal Thackeray and Prime Minister Narendra Modi to win elections, Shiv Sena (UBT) leader Uddhav Thackeray broke his party’s “natural alliance” with the BJP.
After the NCP under Ajit Pawar joined the ruling coalition, Mr Shinde embarked on a tour of the entire state. He addressed a rally in Thane.
He said that these individuals canvassed for votes using the images of Bal Thackeray and PM Modi, then abandoned them by allying with the Congress. They abandoned the voting public and abused the people’s power.
Although PM Modi accomplished Bal Thackeray’s objective of repealing Article 370, Mr. Shinde claimed that Uddhav Thackeray betrayed the PM.
The Chief Minister claimed that many people find it difficult to comprehend his government’s openness and the fact that his official mansion, Varsha, is constantly available to everyone.
In its partnership with the Sena, the BJP acted honourably, according to Mr. Shinde, who added that the saffron party had the opportunity to seize control of the Brihanmumbai Municipal Corporation (BMC) following the 2017 elections but chose to enable the Sena to hold on to power.
The Chief Minister claimed that although the BJP has a sufficient number of supporters, Devendra Fadnavis had a big heart and allowed the Sena to establish a claim. As a result, the Uddhav Thackeray group is now criticising him.
He claimed that during the two-and-a-half years of the Thackeray-led administration, no decisions were made. Mr. Shinde further added that they have Ajit Pawar alongside them, which will quicken their tempo.
Eknath Shinde, the chief minister of Maharashtra, is preparing to begin the “Jansampark Abhiyan” campaign on Thursday amidst recent political changes in the state. On July 13, he will begin a tour across the state from his hometown of Thane City.
