D.Y. Chandrachud is forthcoming to the 50th CJI of India, nominated by CJI U.U.Lalith
The son of Yeshwant Vishnu Chandrachud, the 16th CJI of India as well as the longest-serving CJI in the history of India. If the union government accepts the recommendation of C.J.I. U.U. Lalith, then Justice Chandrachud will make it one of the longest terms in recent times as his tenure will be for the next 2 years till November 10, 2024.
The CJI India Needed the most
It is true in its whole sense that Justice D.Y. Chandrachood is the most needed CJI for India, who broke all the concrete misconceptions that prevailed in social, political and religious areas of India. He has firm beliefs and questions the established beliefs and opinions in the social, political, and religious spheres.
He is known for his liberal and progressive judgements, including the recent verdict upholding the rights of unmarried women to seek abortions during pregnancy up to 24 weeks. 1 This is one of the judgements made by him that raised the dignity and status of women in society. He made an immense effort to ensure the rights and choices of women in society. The widely discussed Supreme Court verdict safeguards women’s privacy and modesty.
His judgement on Shafin Jahan vs. Ashokan K.M on March 8, 2018, popularly known as the Hadiya case, in which he observed that the right to choose a religion and marry is an intrinsic part of the meaningful existence of a woman.
He criticised the government’s reluctance to admit women into the army and navy as short-service officers on the basis of the wrong concept that women are considered weak and fragile emotionally, mentally, and physically. Through his judgement in Nitisha versus Union of India on March 25th 20212, he served justice to eligible female candidates who wish to pursue their career in India’s defence services.
He was also part of the constitution bench which comprised Justice R.F Nariman and Indu Malhotra which decriminalised Sec 377 of the Indian penal code (homosexuality). D.Y. Chandrahood opined that a person’s choice of a partner is a fundamental right, and it can include a same-sex partner.
He showed courage to take a stand on complicated religious issues in India, as diverse religious beliefs are deeply rooted in the minds of Indians, which created several conflicts in the past and present and will have roots in the future also. He was part of the majority panel that upheld the right of women of all ages to enter the Sabarimala temple, and he was also a member of the five-judge bench that decided the Ayodhya-Babri Masjid case.
The Constitution Bench headed by him recently was called the “paperless” bench. He was the advocate of live streaming of Indian courts as well as part of the bench which agreed to live-stream court proceedings. He made it a reality that now every citizen can watch the justice delivery system through their eyes. The Constitution Benches of the Supreme Court are now live-streamed through YouTube. It will serve the cause of access to justice in India. Justice Chandrachoud observed that citizens have a right to know about and follow court proceedings.
The ideals of the Indian Constitution which are supposition by the drafters are going to glance in the future through the Judgements of D.Y. Chandrachud and the historical judgements passed by him will be written in golden words in the minds of future citizens also and he is an inspiration to young lawyers and Judges to serve law and justice how hard the situation may be.
