In recent news, Rahul Gandhi was arrested in a court case and sentenced to two years imprisonment. But the court has also approved his bail on a surety of 15000 rupees. They have also allowed him to appeal and stayed the sentence for 30 days.
Detail Case of Rahul Gandhi
Recently, Rahul Gandhi went to Karnataka for a rally. According to BJP MLA Surat Purnesh Modi, Rahul Gandhi allegedly made some remarks about all the thieves in the nation having names with Modi. Be it Lalit Modi, Nirav Modi and Narendra Modi. Due to this remark, MLA Modi has filed a case of defamation against Gandhi.
The case was presented in a Surat court where they held MP Gandhi guilty in a 2019 defamation case.
Chief Judicial Magistrate H H Verma was the one who pronounced the order. According to sources, Gandhi himself was presented inside the courtroom on Thursday. Accompanying him inside the courtroom were several national and state congress leaders. Due to their presence, the Surat police had increased security arrangements in the court campus so that there won’t be any untoward incidents.
Defense lawyer, Kirit Panwala Not Satisfied
The defense lawyer, Kirit Panwala, for the case has argued that they are not satisfied with the verdict passed by the court. According to him, several arguments were not taken into consideration. He said that the issue they raised is false as there is no community of Modi. The complaint certainly does not include Modi as his name was Bhootwala before.
On the other hand, the prosecution lawyer and MLA Modi gladly agreed with the court order and they were satisfied with it. The MLA has further things to say while defending his surname. He said he belongs to the Modhwanik Ghanchi community and they all have the surname, Modi. He expressed that Gandhi has hurt their sentiments and that is why he took the drastic step to register a complaint against him. There were several people outside supporting the MLA while chanting slogans.
Modi’s earlier Hasmukh Lalwala said that when initially the case was filed, he was sure that the case is strong enough for conviction and that they were going to win for sure. They filed the case under sections 499 and 500 of the Penal code.
Later, it was also reported that Rahul Gandhi won’t have to go to jail immediately and he will get a 30-day time to appeal against his conviction.
Opinion of Other Lawyers
Several lawyers have commented and voiced their opinion regarding the conviction. Gautam Bhatia, a legal scholar has tweeted regarding the same. The conviction does not make any sense as the comment was made regarding a generic class of people. Unless a certain person can prove that the comment was truly for him, the court can not hold the person guilty.
Mr. Gandhi’s Lawyer has further defended that he had given the speech in “favor of democracy”. Also, He is not a resident of Gujarat. Before the complaint, there should have been an inquiry conducted. Furthermore, he argued that there is no community named Modi.
Rahul Gandhi has not given any comment till now or addressed the press regarding the verdict. He has only tweeted a quote from Mahatma Gandhi’s speech. “My religion is based on truth and non-violence. Truth is my God, and non-violence is the means to get it.”
